Terms of Service

These Terms of Service (“Terms”) govern your use of the SGfoto mobile application (the “App”) published by SGfoto (“we”, “us”, or “our”). By installing or using the App, you agree to these Terms.

1. License

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on Apple devices you own or control. This licence does not include the right to:

• Sublicense or resell the App or any output to third parties as a commercial photo-processing service.
• Reverse engineer, decompile, or attempt to extract the AI prompts or model behaviour.
• Use the App to generate photos of any person without that person’s consent.

2. Credit packs

• SGfoto sells one-time credit packs (1, 5, or 20 photos) through Apple’s App Store. There is no subscription. Credits never expire.
• One paid credit lets you generate from a single photo and re-roll that same photo up to 10 times until you are satisfied; switching to a different photo uses another credit.
• Free or gifted credits (for example a sign-up gift or for completing a survey) are provided at our discretion, allow a single generation without re-rolls, and may change without notice.
• Apple’s standard App Store refund policy applies. Refund requests are handled by Apple, not by us.

3. AI-generated content disclaimer

The App uses generative AI to transform your input photo into an ID-photo-compliant output. While we have engineered prompts that aim to meet ICA, MOM, SPF, and various foreign authorities’ photo specifications:

• We do not guarantee that any generated photo will be accepted by the issuing authority. Acceptance is at the sole discretion of the authority you submit to.
• Generated photos are AI reconstructions. Do not submit a generated photo as evidence in any legal, medical, or insurance context.
• You are responsible for reviewing each generated photo before submitting it to any authority.

4. User content

• You retain all rights to the source photo you provide.
• You grant us a limited licence to process the source photo and prompt strictly for the purpose of generating your requested output and operating the App’s history feature on your device.
• You represent that you have the right to use any photo you submit and that you have obtained consent from any person depicted in it.

5. Prohibited uses

You may not use the App to:

• Generate photos that impersonate someone other than the source person.
• Create photos for fraudulent identification or any unlawful purpose.
• Generate sexual content, content depicting minors in any inappropriate context, content promoting violence, or any other content prohibited by Apple’s App Store Review Guidelines.
• Attempt to circumvent rate limits, purchase gates, or any other technical control.

Violation may result in immediate termination of your access and reporting to law enforcement where required.

6. Service availability

The App depends on third-party services (Apple App Store, our backend, the AI generation service). We do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any feature at any time. Any unused credits at the time of discontinuation will be refunded to the original payment method where reasonable.

7. Limitation of liability

To the maximum extent permitted by Singapore law:

• The App is provided “as is” and “as available”, without warranties of any kind, express or implied.
• In no event will we be liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of the App.
• Our total liability to you for any claim arising from these Terms or your use of the App is limited to the amount you paid us in the twelve months preceding the claim.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded under Singapore law.

8. Governing law and dispute resolution

These Terms are governed by the laws of Singapore. Any dispute arising from or in connection with these Terms shall be referred to and finally resolved by arbitration in Singapore administered by the Singapore International Arbitration Centre (SIAC) in accordance with the SIAC Rules then in force.

9. Termination

You may stop using the App at any time by deleting it from your device. We may terminate or suspend your access if you violate these Terms.

10. Changes to these Terms

We may revise these Terms. The “Effective date” reflects the latest version. Material changes will be announced in the App’s release notes. Continued use after a change means you accept the revised Terms.
